The advertisement for Lotto Winning Wheel showed Robert Kingsman, "investment advisor", saying, “I’m in the business of spotting winners and you’re it … I believe you will win this Saturday …” and “you” will be requiring my services.

In the Complainant’s view the advertisement was about “profiting from addiction”.

Code for Gaming & Gambling, Principle 2, Guidelines 2(c) and (d) and Principle 3 Guideline 3(a)

The Complaints Board noted the wording “you will win this Saturday”, was prefaced by the words “I believe” and as such it was a statement of opinion and did not imply an unconditional promise of winning. Also the message was exceptionally hyperbolic and somewhat absurd.

Decision: Complaint Not Upheld
